1. Agreement to Terms

By accessing or using any services provided by Thorsen Digital ("Company," "we," "us," or "our"), including the Zira AI platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

Thorsen Digital provides AI-powered lead capture, response automation, and customer communication services through the Zira AI platform. Services include but are not limited to: website chat widgets, automated follow-up messaging, lead qualification, and appointment booking assistance. The specific features available to you depend on the subscription plan you have purchased.

3. Subscription Plans and Billing

Services are offered on a subscription basis with an upfront setup fee and a recurring monthly charge. By purchasing a plan, you authorize Thorsen Digital and its payment processor (Stripe) to charge your payment method for the upfront fee immediately and the monthly fee on a recurring basis until you cancel. All fees are non-refundable except as described in Section 5 (Performance Guarantee).

You may cancel your subscription at any time by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.

4. Acceptable Use

You agree to use Zira AI only for lawful business purposes. You may not use the service to send spam, harass individuals, violate any applicable law or regulation, impersonate another business, or engage in any activity that could damage the reputation or operation of Thorsen Digital. We reserve the right to suspend or terminate accounts that violate these terms without refund.

5. 30-Day Performance Guarantee

Thorsen Digital offers a limited performance guarantee for the first 30 days of your subscription. If, within that period, you can demonstrate with documented evidence — such as screenshots, logs, or recorded interactions — that Zira AI provided materially false information to a customer, acted in direct contradiction to your configured business instructions, or caused verifiable harm to your business operations, you may submit a refund request to [email protected] for review.

Refunds are issued solely at Thorsen Digital's discretion upon verification of the documented issue. This guarantee does not apply to: cancellations, change of mind, dissatisfaction unrelated to a verifiable AI performance failure, or situations where the AI behaved as configured but the outcome was not what the client expected. The guarantee covers the monthly subscription fee only; upfront setup fees are non-refundable.

6. Intellectual Property

All software, designs, branding, and content associated with the Zira AI platform are the exclusive property of Thorsen Digital. You are granted a limited, non-exclusive, non-transferable license to use the platform for your business during your active subscription. You may not copy, reverse-engineer, resell, or redistribute any part of the platform.

7. Data and Privacy

By using Zira AI, you consent to the collection and processing of data as described in our Privacy Policy. You are responsible for ensuring that your use of Zira AI complies with applicable data protection laws in your jurisdiction, including obtaining any necessary consents from your customers before deploying the widget on your website.

8. Disclaimer of Warranties

The Zira AI platform is provided "as is" without warranties of any kind, express or implied. Thorsen Digital does not guarantee that the service will be uninterrupted, error-free, or that AI responses will always be accurate. AI-generated content should be reviewed and should not be relied upon as professional legal, medical, or financial advice.

9. Limitation of Liability

To the maximum extent permitted by law, Thorsen Digital's total liability to you for any claim arising out of or related to these terms or the services shall not exceed the total amount you paid to Thorsen Digital in the three months preceding the claim. In no event shall Thorsen Digital be liable for indirect, incidental, special, or consequential damages.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify active subscribers of material changes via email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
